While mainly negotiating outright unconditional sales, disposals and acquisitions, we are always mindful of planning upside possibilities and recommend clawbacks and covenants, where appropriate. We are conversant and comfortable in advising on ‘subject to’ planning agreements for leases or conditional disposals and acquisitions, and we always seek to protect the landowner’s or developer’s interests, with particular sensitivity to costs, timescales and funding.
